1. Acceptance of Terms

By creating an account, accessing, or using CHOPCAM, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Description of Service

CHOPCAM is a mobile application that uses artificial intelligence to analyze food images and provide nutritional information, including:

• Glycemic load estimates
• Insulin spike impact analysis
• Inflammation impact assessments
• Nutritional breakdowns and recommendations
• Meal tracking and trend analysis
• Educational content about nutrition and health

3. Medical Disclaimer

IMPORTANT: The information provided by CHOPCAM is for informational and educational purposes only and is not intended as a substitute for professional medical advice, diagnosis, or treatment.

Our AI-powered nutritional analysis provides estimates based on image recognition and may not be 100% accurate. You should:

• Always consult with a qualified healthcare professional before making dietary changes
• Never disregard professional medical advice based on information from the App
• Seek immediate medical attention for any urgent health concerns
• Verify nutritional information independently for critical dietary needs

We do not guarantee the accuracy, completeness, or reliability of any nutritional information provided through the Service. Use of the Service is at your own risk.

4. Account Registration and Security

To access certain features, you must create an account using Apple Sign-In or Google Sign-In. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access
• Be responsible for all activities under your account

You may not share your account with others or create multiple accounts for the same individual.

5. Subscription and Payment Terms

5.1 Free Trial

New users may receive a 3-day free trial of our VIP subscription. Your payment method will be charged at the end of the trial period unless you cancel before the trial expires.

5.2 Subscription Plans

CHOPCAM offers weekly, monthly, and yearly subscription plans providing access to premium features including unlimited meal analysis, advanced tracking, educational content, and trend insights.

5.3 Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

5.4 Cancellation

You may cancel your subscription at any time through:

• iOS: Settings → Your Name → Subscriptions → CHOPCAM
• Android: Google Play Store → Menu → Subscriptions → CHOPCAM

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that time.

5.5 Refunds

All purchases are processed through Apple App Store or Google Play Store and are subject to their respective refund policies. We do not process refunds directly. To request a refund, please contact:

5.6 Price Changes

We reserve the right to modify subscription prices. Price changes will not affect your current subscription period but will apply to subsequent renewals. You will be notified of any price changes in advance.

6. User Content and Data

6.1 Content You Provide

You retain ownership of photos and other content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, and analyze your content solely to provide and improve the Service.

6.2 Data Storage and Processing

We collect and store:

• Meal photographs you upload
• AI-generated nutritional analysis results
• Onboarding responses (health goals, dietary challenges)
• Usage data and preferences
• Account information from authentication providers

Your data is stored securely using Supabase and is subject to our Privacy Policy.

6.3 Prohibited Content

You may not upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains malicious code or harmful materials
• Is intended to abuse or exploit the Service

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the Service
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any systems or data
• Use the Service to transmit harmful code or malware
• Impersonate any person or entity
• Harvest or collect user information without consent

8. Intellectual Property Rights

The Service, including all content, features, functionality, software, and design, is owned by CHOPCAM and is protected by international copyright, trademark, and other intellectual property laws.

Our trademarks, logos, and service marks may not be used without our prior written consent. All other trademarks appearing in the Service are the property of their respective owners.

9. Third-Party Services

The Service integrates with third-party services including:

• Apple Sign-In and Google Sign-In for authentication
• OpenAI for AI-powered nutritional analysis
• Supabase for data storage and backend services
• Apple App Store and Google Play Store for payment processing

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

10.2 AI Accuracy

We do not warrant that AI-generated nutritional analysis will be accurate, complete, or reliable. Results may vary based on image quality, food preparation, and other factors.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOPCAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access to or alteration of your data
• Any health decisions made based on Service information

11. Indemnification

You agree to indemnify, defend, and hold harmless CHOPCAM and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Service

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may terminate your account at any time by contacting us or deleting the App. Upon termination:

• Your right to use the Service will immediately cease
• Active subscriptions will continue until the end of the billing period
• We may delete your data in accordance with our Privacy Policy
• Provisions that should survive termination will remain in effect

13. Data Deletion and Privacy

You have the right to request deletion of your personal data at any time. To request data deletion:

• Go to the Account tab in the App
• Select "Delete Account" or contact us at support@chopcam.com

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the App at least 30 days before the changes take effect.

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Dekalb County, Georgia, USA without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Association], except that either party may seek injunctive relief in court.

16. Geographic Restrictions

The Service is controlled and operated from the United States. We make no representations that the Service is appropriate or available for use in other locations. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CHOPCAM regarding the Service and supersede all prior agreements and understandings.

19. Apple App Store Additional Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and CHOPCAM only, not with Apple
• Apple has no obligation to provide maintenance and support services
• Apple is not responsible for addressing any claims relating to the App
• Apple is a third-party beneficiary of these Terms and may enforce them
• You must comply with applicable third-party terms when using the App

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
